LIQUOR LICENSE APPLICATION AND PROCEDURE

Herewith, the following information required, should our offices be instructed to proceed with the Application of a Liquor License (please be advised that should you require more than 1 (one) liquor license, the information will be required for each of the liquor Licenses): 

 

- Instructions as to which Liquor License is required – this will have an impact on the Application Fee as well as the Annual License Fee;

- Pertaining to a Close Corporation and should you trade in the name of a Close Corporation, the Founding Statement together with the Amended Founding Statement (Please note that the principal of business on your company documents should state that you will be selling liquor;

- Income Tax Certificate;

- Provisional Tax Letter from Accountants (to confirm that Tax is paid);

- VAT Certificate (if applicable);

- Social Security Certificate of Good Standing (if applicable) of Close Corporation, as the case may be;

- Code of Conduct of the member/s of the Close Corporation (may not be older than 6 months);

- Copy of Deed of Transfer confirming ownership of the premises, alternatively a Lease Agreement, in the event that the Property is rented by you from the Landlord;

- Building plans / Sketch Plans *clearly show lockable storage for alcohol and restrooms and ventilation*;

- Description of premises (kindly confirm whether you require us to provide you with an example, which example is in accordance with the Liquor Board’s directive)

- Valid Fitness Certificate (until 2023);

- Valid Business Certificate (until 2023);

- Identity Document / Passport of the Member/s of the Close Corporation.  (in the event that any of the Members are not ‘n Namibian Citizen, proof of permanent residence alternatively, document confirming that individual is lawfully admitted for permanent residence to, and resident in, Namibia)

 

Furthermore, the Board will require the following documentation, with which we will be able to assist (once the afore-said documentation has been delivered to our offices):

 

·         Affidavit of Financial Interest;

·         Power of Attorney;

·         If applicable, Members’ Resolution (in the event that a Close Corporation will trade);

·         Consent by Owner to Trade.

 

 Form 1  needs to be completed and signed by the Applicant (Should the Applicant trade in the name of a Close Corporation, the document must be completed in the name of the Close Corporation.)

 

Please be so kind as to return the duly signed and completed Form 1 along with the above information. (for now, you are welcome to provide us with a copy of the duly signed document via email (for purposes of preparing our Advertisement for timeous submission, we will however prior to submission of the Application to the Magistrate’s Court, require the original signed and completed Application Form from you)

 

*Kindly be mindful:  in the event that the liquor License is granted conditionally, the “working” of the actual liquor License will only come into effect upon such time that the outstanding matters / documentation have been handed in, therefore to have a liquor License which has been granted conditionally, will still result in you being in a position where you have no liquor License.*

 

Also as per our discussion, the Liquor License Committee Meetings for the remainder of the year (2022) are as follows:

 

  1. 11 MAY 2022;
  2. 8 JUNE 2022;
  3. 13 JULY 2022;
  4. 10 AUGUST 2022;
  5. 14 SEPTEMBER 2022;
  6. 12 OCTOBER 2022;
  7. 9 NOVEMBER 2022;
  8. 14 DECEMBER 2022.

 

Please be mindful of the below important information:

 

  1. *LODGEMENT OF APPLICATIONS:

Applications to be lodged in not more than 60 days and not less than 42 days*

 

2.       *ADVERTISEMENT OF APPLICATION, PRIOR TO LODGEMENT OF APPLICATIONS:

A person who intends to lodge an application referred to in regulation 13 in terms of the Liquor Act, must advertise the application by publishing a notice, in the manner as prescribed by regulation 10 of the Liquor Act - in the form as set out in Form 2 (of the Regulations) and not more than 14 days and not less than 7 days before the date on which the application will be lodged with the clerk of the court.
